These General Terms and Conditions apply to all services and products of Fotowaschbaer, a sole proprietorship registered in Austria and owned by Franz Robert Berger (registered trade location Hofackerstrasse 18, 6974 Gaissau, Austria; business address Feldstrasse 36, 9445 Rebstein, Switzerland). By placing an order or booking you accept these terms.
Fotowaschbaer offers outdoor, equestrian and event photography, private photography sessions and the sale of digital photos. Detailed service descriptions, pricing and conditions are available on the website and within each service listing.
Photography services are requested via the contact form or by email and confirmed by Fotowaschbaer by email. A booking becomes binding with that confirmation.
Payment terms – due date and any deposit – are set out in the confirmation email. Unless agreed otherwise there, the full amount is due upon confirmation.
Cancellation terms are communicated when the booking is confirmed. Please send cancellation requests to office@foto-waschbaer.com.
Payments are processed securely via Stripe. Which payment methods you can choose from depends on your country, the currency and your device; you will see the available methods at the payment step. Typically these are credit and debit cards (Visa, Mastercard, American Express), PayPal and your device's payment services such as Apple Pay and Google Pay. As a small business, Fotowaschbaer is exempt from VAT: all prices shown are final prices, no VAT is added or stated.
Purchased digital photos are licensed for both personal and commercial use. The customer receives full usage rights for the purchased images, including the right to use them for personal projects, social media, print products, and commercial purposes.
Digital photos are made available before the withdrawal period ends; by purchasing you expressly agree to this. The right of withdrawal lapses with the first download of the photos (Art. 16(m) Directive 2011/83/EU, § 18 para. 1 no. 11 FAGG). Until the first download you may withdraw; after that the purchase is non-refundable. The time of download is logged.
Digital photos are delivered via a secure, time-limited download link sent to the email address provided at checkout – usually within 48 hours, and no later than 7 days after payment.
Prints: On request we produce prints of the purchased photos in 15 × 20 cm (included in the price for single photos; in the flat rate up to 8 prints per rider, each further 8 at CHF 5.–). They are either picked up at the stand at the event or sent by post (flat shipping fee CHF 5.– per order, usually within 7 days of payment). The prints are made specifically for you from the images you selected; there is no right of withdrawal for them (Art. 16(c) Directive 2011/83/EU, § 18 para. 1 no. 3 FAGG). You receive the digital photos in any case.
All photographs are protected by copyright under the Austrian Copyright Act (UrhG) and international copyright treaties. The photographer (Franz Robert Berger / Fotowaschbaer) retains copyright and moral rights in all images.
The photographer retains the right to use all photographs for portfolio display, marketing, and promotional purposes, unless the customer explicitly requests otherwise in writing at the time of booking.
Customers who purchase digital photos receive a broad usage license as described under 'Digital Products'. This license is non-exclusive and transferable.
Fotowaschbaer's liability is limited to the value of the assignment or order in question. This limitation does not apply to damage caused by wilful misconduct or gross negligence, nor to personal injury.
Fotowaschbaer is not liable for non-performance or delays caused by events beyond reasonable control, including but not limited to natural disasters, severe weather, illness, pandemic restrictions, road closures, or other force majeure events. In such cases, Fotowaschbaer will offer rebooking or a full refund.
Fotowaschbaer takes all reasonable precautions to ensure equipment reliability. In the unlikely event of complete equipment failure, liability is limited to a full refund of the booking amount.
These terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer-protection provisions of their country of residence also apply. Where legally permissible, the competent court in Austria has jurisdiction.
We are neither obliged nor willing to take part in dispute-resolution proceedings before a consumer arbitration board. For questions or complaints, contact us at office@foto-waschbaer.com – as a rule we find a solution directly.
